EMToxLegal assists plaintiff and defense counsel with matters involving emergency medicine, medical toxicology, and addiction medicine. Each assignment is screened for the selected physician’s expertise, conflicts, availability, and the work required.

Initial screening and case assessment

An introductory discussion addresses the medical issues, requested services, deadlines, and potential fit. Substantive screening may include a focused review of specified records and a discussion of the preliminary findings. Flat-rate screening may be available when the record volume, questions, and deliverable are defined in advance.

An initial screening opinion is limited to the material reviewed and the agreed scope. It is not automatically a complete expert report or an agreement to testify. Requests for affidavits or similar submissions require review of the specific assignment, applicable qualification requirements with counsel, and the deadline.

Medical-record and literature review

Review can include a chronology of the relevant events, assessment of clinical decisions, identification of material gaps, and a focused evaluation of pertinent medical literature. Original records and source references remain central to the analysis.

Standard-of-care and causation analysis

Assignments may address the care provided, the effects of an exposure or medication, the relationship to the outcome, or more than one of these questions. The scope is agreed with counsel, and limitations or additional information needed are identified during the review.

Attorney consultation and written reports

Deliverables may include a case conference, written opinions, an expert report, or a supplemental review of newly supplied material. The format, record cutoff, requested questions, and delivery schedule should be established at the outset.

Deposition and trial testimony

Deposition and trial work is considered subject to the expert’s review, qualifications for the assignment, scheduling, and engagement terms. Nationwide matters are considered, with travel and remote arrangements discussed individually.

What to expect when engaging an expert

  1. Initial inquiry: provide a general overview, jurisdiction, desired services, and deadlines without sending sensitive records.
  2. Screening: confirm the relevant parties for conflicts and establish whether the matter fits the expert’s experience and availability.
  3. Written scope and terms: agree on services, fees, any retainer, deliverables, and deadlines before substantive work starts.
  4. Records and review: arrange appropriate transfer of the relevant material and identify missing information or changes in scope.

Fees and availability

Fee schedules are available on request. The initial telephone discussion of fit and scope is complimentary; substantive record review begins after engagement terms are agreed. Any fixed-fee screening must specify the included record volume, deliverable, and treatment of supplemental records or additional questions.

Availability and anticipated turnaround are confirmed after reviewing scope, record volume, conflicts, and deadlines. Receipt of an inquiry does not reserve an expert or confirm a deadline.
